Sex crimes cases are extremely sensitive and emotionally charged. Charges involving sex crimes are usually prosecuted very aggressively, and jurors in a sex crimes case will often assume the defendant's guilt.

In my experience as a criminal defense attorney, successful defense of cases involving criminal sexual conduct requires a great deal of insight, careful investigation and preparation of a defense. I must demonstrate why my client would not or could not have committed the crime and reveal motivations on the part of the accuser.

The Penalties for Conviction on Sex Crimes Charges

The penalties upon conviction of a sexual offense are extremely severe. Prison time is almost a certainty, and convicted sex offenders rarely are eligible for early parole.

After release from prison, convicted sex offenders must register with the Public Sex Offender Registry (PSOR). This registry, which includes a convict's name and current address, is a public record. Anyone has access to the sex offender registry, including landlords, employers and neighbors.

My job as a criminal defense lawyer is to do everything possible to prevent a conviction for criminal sexual conduct. If we can fight the charge, we will — up to and including a trial, if necessary. In other circumstances, our best strategy may be to negotiate a plea bargain. In such situations, I argue aggressively for a reduced charge that will keep my client off of the sex offender registry and out of prison.

The Prosecutor charged my teenage client with attempted rape, a felony that could have led to incarceration and registration on the sex offender list.

We took the case to trial where I demonstrated that the accuser exaggerated the sexual element of the charge. I convinced the jury that the incident was, in fact, a teenage prank. The jury convicted my client — but only of a misdemeanor (non-sexual) assault instead of a felony sexual assault. My client received probation.
